TalePop Terms of Service

TalePop is a product of SnarkyByte LLC ("SnarkyByte", "we", "us", "our"). These Terms govern your use of the TalePop app and related services (the "Service"). By using the Service, you agree to these Terms. Your use of the Service is also subject to our Privacy Policy.

1) Eligibility

TalePop is intended to be used by parents or legal guardians who create and control the account. Children may use the Service only under a parent/guardian's supervision. You must be 18+ (or the age of majority where you live) to create an account.

2) Accounts

You're responsible for activity under your account and for keeping your login details secure. Please provide accurate contact information and keep it up to date.

3) Pricing

The Service is currently provided free of charge. We reserve the right to introduce fees, subscriptions, or paid features at any time and at our sole discretion. If we do, use of paid features will require payment at the applicable rates. We are under no obligation to keep any part of the Service free or to maintain any particular pricing.

4) AI-generated content

TalePop creates stories using a combination of artificial intelligence and human-designed safety and quality controls. Despite these measures, generated content may occasionally contain mistakes, omissions, inaccuracies, or unexpected results — including content that some users may find surprising, confusing, or upsetting. The Service and generated content are for entertainment and general use only and are not professional advice (medical, legal, psychological, educational, or otherwise). Do not use the Service for urgent situations or safety-critical decisions.

5) Parental responsibility and assumption of risk

By using the Service, you acknowledge and agree that:

  • You (the parent/guardian) are solely responsible for supervising your child's use of the Service and for evaluating whether any generated content is appropriate for your child.
  • AI-generated stories may occasionally produce content that is unexpected, inaccurate, or that your child may find confusing or upsetting, despite our safety measures.
  • TalePop is not liable for any emotional distress, psychological impact, developmental effect, behavioral outcome, or any other harm — whether to a child, a parent/guardian, or any other person — arising from the use of the Service or exposure to generated content.
  • You assume all risk associated with your and your child's use of the Service.

6) Safety rules for inputs

You agree not to submit:

  • sensitive personal information about a child (address, phone number, school, exact location, etc.)
  • illegal, harmful, abusive, or sexually explicit content
  • any sexual content involving minors
  • attempts to bypass safety restrictions

If we detect sensitive child information or content that violates these Terms, we may remove it.

7) Ownership

We own the Service (software, design, branding, and underlying systems) and the story outputs delivered through the Service ("Generated Content"). You keep ownership of what you submit ("Inputs").

8) License to TalePop (to run the Service)

You give us permission to host, process, and use your Inputs only to provide, maintain, and improve the Service and to enforce safety and quality rules.

9) Your license to Generated Content (commercial allowed)

We give you a worldwide, perpetual, non-exclusive, royalty-free license to use Generated Content for any purpose, including commercial use (publish, sell, monetize, adapt, create derivative works, etc.). This license is transferable and sublicensable for commercial purposes.

10) No guarantee of originality or non-infringement

You understand that:

  • Generated Content may be similar to content generated for other users or to existing works.
  • We do not guarantee Generated Content is original, unique, accurate, or non-infringing.
  • If you use Generated Content commercially, you are responsible for reviewing it and getting any permissions/clearances you may need.

11) Analytics

We use third-party analytics tools to understand how the Service is used and improve it. We do not send your email address or your first/last name to these providers, and we aim to minimize identifiers shared with them. Analytics may still include technical/device data and in-app actions. Please see our Privacy Policy for more details.

12) Content removal and termination

We may, at our sole discretion and for any reason or no reason, suspend, restrict, or permanently terminate your access to the Service at any time, without prior notice and without obligation to provide an explanation. We may also remove any Inputs or Generated Content at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may stop using the Service at any time.

13) Copyright complaints

If you believe content in the Service infringes your copyright, email [email protected] with: (1) the work you believe is infringed, (2) where the content appears in the Service, (3) your contact info, (4) a statement that you have a good-faith belief the use is not authorized, and (5) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf. We may remove content while we review.

14) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNARKYBYTE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND ORIGINALITY OF ANY GENERATED CONTENT. SNARKYBYTE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SAFE, OR THAT GENERATED CONTENT WILL BE APPROPRIATE, ACCURATE, OR SUITABLE FOR ANY PARTICULAR AUDIENCE, INCLUDING CHILDREN. USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

15) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNARKYBYTE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY GENERATED CONTENT. THIS INCLUDES, WITHOUT LIMITATION: DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF DATA, PROFITS, OR GOODWILL; AND ANY CLAIMS FOR EMOTIONAL DISTRESS, PSYCHOLOGICAL HARM, DEVELOPMENTAL IMPACT, BEHAVIORAL EFFECTS, MENTAL SUFFERING, OR ANY OTHER PERSONAL INJURY OR HARM — WHETHER TO A CHILD, PARENT, GUARDIAN, OR ANY OTHER PERSON — REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF SNARKYBYTE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, SNARKYBYTE'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE ACTUALLY PAID TO SNARKYBYTE FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16) Indemnity

If someone makes a claim against us because of your Inputs or what you publish/monetize from the Service, you agree to defend, indemnify, and hold us harmless from related losses, liabilities, damages, and reasonable legal fees arising from: (a) your Inputs, (b) your use, publication, or monetization of Generated Content, (c) your violation of these Terms, or (d) your violation of third-party rights.

17) Changes

We may update these Terms at any time, with or without notice. The most current version will always be available within the app. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. It is your responsibility to review the Terms periodically for changes.
